I assume you mean HR 1761, Copyright Damages Improvement Act, which include's Hatch's amendment, that is actually no where in the language of the bill as it is just an amendment that happened in1999?

Suggest reading it and finding theft in the bill. The Hatch 1257 amendment you mention raised infringement fines. Only reference to theft is the title, not the law itself, which has been amended since. Upon reading it you will see it is distinguishably infringement everywhere not theft. There is a reason, as by law, definition, etc, they are two distinct acts.

Well stated CDI. Was at a venue/band shoot last night, and six different folks already have my work as their profile pic. Also got two scheduled shoots as a result and likey two more pending scheduling.

I really hate it when they scan one of my photos, and then used it on facebook and tell everybody its mine..... And its a crappy copy. Just GREAT!

Why don't you include a free facebook size photo with each photo they buy? that way they will have an amazing image of yours (you can even put your watermark on them!) to show to their online friends which will be generating more business for you? (as opposed to them looking at the crappy scanned photo).

As I said up in post #8:

"At this point, providing a few images for Facebook is just a regular freebie of doing business with me. I crop it to the proper Facebook proportions and put my logo in a banner on the bottom--people don't crop it out. No, I don't put a copyright symbol on it--I'm giving it to them for that use."

OP - I had that happen by an attendee of a wedding I shot. I wrote FB and within a day the picture was removed. Coincidentally (or maybe not!), the sisters of the girl who posted also removed pics that had been copied from my site. This was a friends wedding so I had a lot of visibility to to all the attendees fb pages and it was a good test. From that point forward, I have and will forever watermark everything I ever post online.

Most of it is stumbled upon. I did some graphic design work for a business sent him some mock up samples of work for his business. He then posted the images using them to promote business and ignored me afterwards. So I contacted FB and the images were removed in a matter of hours.
